Le juge Jean-Louis Bruguière s'apprête à livrer les conclusions de son enquête sur l'attentat qui, en 1994, coûta la vie au président Habyarimana. Craignez-vous d'être incriminé?
Je ne vois pas sur quelle base il pourrait inculper quelque officiel
rwandais que ce soit. Pour le moins, le magistrat idoine pour enquêter là-dessus ne peut venir d'un pays dont certains citoyens sont impliqués dans ce dossier ou dans d'autres, antérieurs à l'attentat et au génocide. sérieux. Par ailleurs, ce juge n'a jamais mis les pieds au Rwanda. Il a concentré son travail sur des individus suspects de génocide. Et qui, bien entendu, s'efforcent de mouiller notre mouvement. Bizimungu ? Je n'ai rien à voir avec cela
 
Même question quant à votre prédécesseur, Pasteur Bizimungu, emprisonné pour activité politique illégale, propos sectaires, atteinte à la sûreté de l'Etat et corruption. Je ne peux répondre de manière complète à ce jour. Il ne suffit pas d'afficher son ambition. Encore faut-il remplir les conditions légales. Le concernant, j'ignore ce que décidera la justice, et je n'ai bien sûr rien à voir avec cela. (L'Express)

Où est le sérieux ?
 
Le 10/02/03, l'ancien président de la République Pasteur Bizimungu et l'ancien ministre Charles Ntakirutinka ont de nouveau comparu à la Cour d'appel. Ils se sont tous deux pourvus en appel en raison de la décison du Tribunal de Première Instance de continuer les poursuites en mettant de côté le motif principal de leur détention provisoire, à savoir la création illégale d'un parti politique. Selon Bizimungu après l'enquête menée par la police judiciaire sur le parti PDR, , le parquet s'est rendu compte que la création d'un parti n'était illégale... il a alors été décidé (par les accusateurs de Bizimungu) de changer l'acte d'ac-cusation. Gacaca praised by victims and accused - Pres. Kagame
 
Gacaca is an attempt to deal with the huge numbers of people involved in
genocide accusations, many in prison. The aim was to set up a place where
people could tell the truth. Justice could then be done, but there could also be
some hope of reconciliation. People are not able to forget, but they are able to
forgive in some circumstances. The process has had success in dealing with
some sort of wrongdoing. It has won praise from victims and the accused.

Les juges, dont beaucoup sont illettrés, n'ont reçu que six jours de formation. De surcroît, certains d'entre eux peuvent difficilement être comptés parmis les "personnes intègres", d'après African Rights.
"L'allégation la plus inquiétante, portée par les juges et par ceux qui les ont formés, est que parmi les Inyangamugayo, on compte des hommes et des femmes ayant activement pris part au génocide".

Un premier bus escorté par des policiers a transporté quelque 70
détenus en direction du camp (militaire, NDLR) Kami. Le mauvais état de la route les a contraints à terminer le trajet à pied, sous l'oeil des policiers. Ces détenus, qui bénéficient d'une liberté provisoire, vont suivre des "cours de rééducation" dans le camp pendant quelques semaines avant de réintégrer leurs communautés.

The Rwandan government, dominated by the Rwandan Patriotic Front (RPF), demonstrated continuing hostility towards political dissent, press freedom, and an independent civil society as it moved towards a new constitution and national elections in 2003. Eight years after the 1994 genocide that killed at least half a million Tutsi, the government launched gacaca, an innovative, participatory, state-run justice system meant to speed up genocide trials and promote reconciliation. But its concern for justice had limits: It refused to let gacaca jurisdictions hear allegations of Rwandan Defense Force (RDF,
formerly Rwandan Patriotic Army, RPA) war crimes, and it tried to stop the United Nations International Criminal Tribunal for Rwanda from investigating RDF suspects.

The tribunal announced that Musabyimana died at the Kilimanjaro Christian
Medical Centre in Moshi "after a long illness". He is a former Anglican bishop
of the diocese of Shyogwe in Rwanda. He becomes the first accused person
to die in ICTR detention.

Prisons : Quick decongestion... 8 years later
 
The prisoners freed on Tuesday included 12,628 who had been ranked
in the second and third categories of the government's list of genocide
 suspects; 1,966 who had been acquitted of their crimes under
Gacaca law; 1,792 who had confessed and been sentenced before
Gacaca; 1,116 who were minors (between 14 and 18 years) during the
 1994 genocide; 937 who were charged with crimes unrelated to
genocide; 105 former rebels; 302 who were released by the
prosecution department; and another 302 who had confessed, and
their files were already in national courts.

Provisional Liberty in Hirondelle

Some genocide survivors' organisations and human rights organisations
have criticised the process. "We fear that this expected decision will
undermine efforts to deliver justice for the victims of the 1994
genocide through the gacaca courts", reads a statement from human
rights watchdog, African Rights.
